This website is operated by Farmstead Scattering Garden LLC. Throughout the site, the terms “we,” “us,” and “our” refer to Farmstead Scattering Garden. By visiting our site and/or purchasing our ash scattering services, you agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”), including the additional terms, conditions, and policies referenced herein and available by hyperlink. These Terms of Service apply to all users of the site, including but not limited to browsers, customers, and contributors.

By accessing or using this site, you agree to these Terms. If you do not agree to all the terms and conditions, you may not use our services.

Our store and services are hosted on Shopify Inc., which provides the online e-commerce platform allowing us to deliver our ash scattering experiences to you.

SECTION 1 - SERVICES OFFERED

Farmstead Scattering Garden provides scattering services for cremated remains of loved ones or pets. By purchasing from us, you acknowledge the personal and emotional nature of these services and agree to provide accurate and complete information to ensure the proper fulfillment of your order.

All scattering services adhere to environmental guidelines and respect the integrity of our property and your loved one's wishes. Special instructions or specific scheduling requests must be confirmed in advance during the order process.

SECTION 2 - CHANGES AND CANCELLATIONS

Once cremated remains are received, we allow a 24-hour period for changes to your instructions unless a specific scattering date is requested. After this time, the scattering process begins and changes cannot be accommodated.

If you request the return of cremated remains before scattering, shipping charges will apply. We reserve the right to refuse service if we believe your instructions violate our policies or the law.

SECTION 3 - REFUND POLICY

Due to the unique nature of ash scattering, refunds are generally not provided once services are initiated. Refunds for unused services may be granted on a case-by-case basis, as outlined in our Refund Policy.

SECTION 4 - CUSTOMER OBLIGATIONS

By using our services, you agree:

  • To provide accurate and complete information about the deceased or pet and any specific scattering instructions.
  • The ashes will be received within five years of the order date. AFter five years, the order will be considered closed and fulfilled. 
  • That the cremated remains you send are lawful and comply with all applicable regulations.
  • Not to submit remains that include prohibited materials or contaminants.

We reserve the right to refuse or return cremated remains that do not meet these standards, with any associated shipping fees charged to you.

SECTION 5 - ENVIRONMENTAL AND LEGAL COMPLIANCE

Farmstead Scattering Garden ensures that all ash scattering complies with environmental regulations and property use guidelines. By using our services, you agree that your instructions conform to all legal requirements, including the certification of cremated remains.

SECTION 6 - LIMITATION OF LIABILITY

Our services are provided "as is" and "as available." While we strive to ensure the highest level of care and respect, we do not guarantee that all scattering instructions will be followed in the event of circumstances beyond our control (e.g., weather, natural events).

Farmstead Scattering Garden shall not be held liable for any loss, claim, or damages arising from the scattering experience, whether direct or indirect, beyond the service fees paid.

SECTION 7 - GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved within this jurisdiction.
